　Article 1 This Law is enacted in accordance with the Constitution with a view to defending the dignity of the National Flag, regulating the use of the National Flag, enhancing citizens" consciousness of the state, carrying forward the spirit of patriotism, and cultivating and practicing core socialist values. 第一条

　 为了维护国旗的尊严，规范国旗的使用，增强公民的国家观念，弘扬爱国主义精神，培育和践行社会主义核心价值观，根据宪法，制定本法。

　Article 2 The National Flag of the People"s Republic of China shall be a red flag with five stars. 第二条

　 中华人民共和国国旗是五星红旗。

　The National Flag of the People"s Republic of China shall be made according to the Directions for the Making of the National Flag promulgated by the Presidium of the First Plenary Session of the Chinese People"s Political Consultative Conference. 中华人民共和国国旗按照中国人民政治协商会议第一届全体会议主席团公布的国旗制法说明制作。

　Article 3 The measurement in common use for the National Flag shall include the five sizes specified in the Directions for 第三条

　Article 4 The National Flag of the People"s Republic of China is the symbol and hallmark of the People"s Republic of China. 第四条

　All citizens and organizations shall respect and care for the National Flag. 每个公民和组织，都应当尊重和爱护国旗。

　Article 5 The National Flag shall be displayed daily in the following places or premises of institutions: 第五条

　 下列场所或者机构所在地，应当每日升挂国旗：

　(1) Tian"anmen Square and Xinhuamen in Beijing; （一）北京天安门广场、新华门； (2) The Central Committee of the Communist Party of China, the Standing Committee of the National People"s Congress, the State Council, the Central Military Commission, the CPC Central Commission for Discipline Inspection, the National Supervisory Commission, the Supreme People"s Court, and the Supreme People"s Procuratorate; （二）中国共产党中央委员会，全国人民代表大会常务委员会，国务院，中央军事委员会，中国共产党中央纪律检查委员会、国家监察委员会，最高人民法院，最高人民检察院； National Committee of the Chinese People"s Political Consultative Conference; 中国人民政治协商会议全国委员会； (3) The Ministry of Foreign Affairs; （三）外交部； (4) Airports, harbours and railway stations of entry or exit and other frontier ports, frontier stations and coastal defence stations. （四）出境入境的机场、港口、火车站和其他边境口岸，边防海防哨所。

　Article 6 The National Flag shall be raised in working days in the following premises of institutions: 第六条

　下列机构所在地应当在工作日升挂国旗：

　(1) All central departments and local committees at all levels of the Communist Party of China. （一）中国共产党中央各部门和地方各级委员会； (2) All departments of the State Council. （二）国务院各部门； (3) The standing committees of the local people"s congresses at all levels. （三）地方各级人民代表大会常务委员会； (4) Local people"s governments at all levels. （四）地方各级人民政府；

　(5) Local disciplinary inspection committees and local supervisory committees at all levels of the Communist Party of China. （五）中国共产党地方各级纪律检查委员会、地方各级监察委员会； (6) Local people"s courts at all levels and special people"s courts. （六）地方各级人民法院和专门人民法院； (7) Local people"s procuratorates at all levels and special people"s procuratorates. （七）地方各级人民检察院和专门人民检察院； (8) Local committees at all levels of the Chinese People"s Political Consultative Conference. （八）中国人民政治协商会议地方各级委员会； (9) All democratic parties and people"s organizations. （九）各民主党派、各人民团体； (10) Relevant offices of the Central People"s Government in the Hong Kong Special Administrative Region and relevant offices of the Central People"s Government in the Macao Special Administrative Region. （十）中央人民政府驻香港特别行政区有关机构、中央人民政府驻澳门特别行政区有关机构。

　Schools shall raise the National Flag daily, except during winter vacations, summer vacations and rest days. Kindergartens with conditions shall raise the National Flag by reference to school rules. 学校除寒假、暑假和休息日外，应当每日升挂国旗。有条件的幼儿园参照学校的规定升挂国旗。

　Libraries, museums, cultural centers, art galleries, science and technology museums, memorial halls, exhibition halls, gymnasiums, youth palaces and other public cultural and sports facilities shall raise and fly the National Flag on open days. 图书馆、博物馆、文化馆、美术馆、科技馆、纪念馆、展览馆、体育馆、青少年宫等公共文化体育设施应当在开放日升挂、悬挂国旗。

　Article 7 State organs at all levels, all mass organizations, and public places such as large squares and parks shall raise the National Flag on the National Day, the International Labour Day, the New Year"s Day, the Spring Festival, the National Constitution Day and other important festivals and anniversaries; and the National Flag may be raised, when conditions permit, in premises of enterprises and public institutions, villagers" committees and residents" committees, and residential compounds (buildings and communities). 第七条

　 国庆节、国际劳动节、元旦、春节和国家宪法日等重要节日、纪念日，各级国家机关、各人民团体以及大型广场、公园等公共活动场所应当升挂国旗；企业事业组织，村民委员会、居民委员会，居民院（楼、小区）有条件的应当升挂国旗。

　In an ethnic autonomous area, the National Flag shall be raised on the anniversary of the founding of the ethnic autonomous region and during major traditional festivals of the ethnic minorities. 民族自治地方在民族自治地方成立纪念日和主要传统民族节日应当升挂国旗。

　When a constitutional oath-taking ceremony is held, the National Flag shall be raised at the place where the oath is 举行宪法宣誓仪式时，应当在宣誓场所悬挂国旗。

　Article 9 The state encourages citizens and organizations to use the National Flag and the design thereof to express their patriotic feelings on appropriate occasions. 第九条

　Citizens and organizations that use the design of the National Flag shall abide by relevant provisions on network administration, and may not undermine the dignity of the National Flag. 公民和组织在网络中使用国旗图案，应当遵守相关网络管理规定，不得损害国旗尊严。

　The standard version of the design of the National Flag used online is available on the website of the National People"s Congress and the website of the State Council. 网络使用的国旗图案标准版本在中国人大网和中国政府网上发布。

　Article 10 Measures for the display and use of the National Flag in diplomatic activities and by the Chinese embassies and consulates stationed in foreign countries and other diplomatic representative agencies shall be prescribed by the Ministry of Foreign Affairs. 第十条

　Article 11 The measures for the raising and use of the National Flag by the Chinese People"s Liberation Army and the Chinese People"s Armed Police Force shall be developed by the Central Military Commission. 第十一条

　 中国人民解放军和中国人民武装警察部队升挂、使用国旗的办法，由中央军事委员会规定。

　Article 12 Measures for the display of the National Flag by civilian vessels or foreign vessels entering Chinese territorial waters shall be prescribed by the competent department in charge of communications under the State Council. 第十二条

　 民用船舶和进入中国领水的外国船舶升挂国旗的办法，由国务院交通主管部门规定。

　The measures for the raising of the National Flag by vessels on exit-entry frontier inspection, border administration, and public security duties shall be developed by the public security department of the State Council. 执行出入境边防检查、边境管理、治安任务的船舶升挂国旗的办法，由国务院公安部门规定。

　The measures for the raising of the National Flag by vessels of national integrated fire and rescue teams shall be developed by the emergency management department of the State Council. 国家综合性消防救援队伍的船舶升挂国旗的办法，由国务院应急管理部门规定。

　Article 13 The National Flag, when displayed under Articles 5, 6 and 7 of this Law, shall be hoisted in the morning and lowered in the evening. 第十三条

　 依照本法第五条、第六条、第七条的规定升挂国旗的，应当早晨升起，傍晚降下。

　Where the National Flag shall be displayed under this Law, when the weather is inclement, it is permissible that the Flag not be displayed. 依照本法规定应当升挂国旗的，遇有恶劣天气，可以不升挂。

　Article 14 When the National Flag is displayed, a Flag-hoisting ceremony may be held. 第十四条

　升挂国旗时，可以举行升旗仪式。

　The National Anthem shall be played and sung when a Flag-raising ceremony is held. While the National Flag is being raised, persons present shall face the Flag and stand at attention to salute the Flag, salute with eyes, or salute as required, and may not conduct any act impairing the dignity of the National Flag. 举行升旗仪式时，应当奏唱国歌。在国旗升起的过程中，在场人员应当面向国旗肃立，行注目礼或者按照规定要求敬礼，不得有损害国旗尊严的行为。

　Flag-raising ceremonies shall be held daily in the Tiananmen Square in Beijing. 北京天安门广场每日举行升旗仪式。

　A school shall hold a Flag-raising ceremony once a week, except during vacations. 学校除假期外，每周举行一次升旗仪式。

　Article 15 The National Flag shall be lowered to the half staff as a token of mourning when the following persons pass away: 第十五条

　 下列人士逝世，下半旗志哀：

　(1) President of the People"s Republic of China, Chairman of the Standing Committee of the National People"s Congress, Premier of the State Council and Chairman of the Central Military Commission; （一）中华人民共和国主席、全国人民代表大会常务委员会委员长、国务院总理、中央军事委员会主席； (2) Chairman of the National Committee of the Chinese People"s Political Consultative Conference; （二）中国人民政治协商会议全国委员会主席； (3) Persons who have made outstanding contributions to the People"s Republic of China; （三）对中华人民共和国作出杰出贡献的人； (4) Persons who have made outstanding contributions to world peace or the cause of human progress. （四）对世界和平或者人类进步事业作出杰出贡献的人。

　Where a state memorial ceremony is held, or any serious natural calamity, public health emergency or any other unfortunate event occurs, causing especially serious casualties, the National Flag may be flown at half-mast as a token of mourning nationwide or in certain areas or specific places. 举行国家公祭仪式或者发生严重自然灾害、突发公共卫生事件以及其他不幸事件造成特别重大伤亡的，可以在全国范围内下半旗志哀，也可以在部分地区或者特定场所下半旗志哀。

　The fly at half-mast of the National Flag in accordance with the provisions of paragraph 1 (3) and (4) and paragraph 2 of this article shall be reported by the relevant departments of the State Council or the people"s governments of provinces, 依照本条第一款第三项、第四项和第二款的规定下半旗，由国务院有关部门或者省、自治区、直辖市人民政

　autonomous regions, and municipalities directly under the Central Government to the State Council for decision. 府报国务院决定。

　Dates and places for the half-staffing of the National Flag under this Article shall be decided by the funeral organ established by the State, or shall be decided by the State Council. 依照本条规定下半旗的日期和场所，由国家成立的治丧机构或者国务院决定。

　Article 16 When mourning ceremonies for the following persons who have passed away are held, their remains, coffins or urns may be covered with the National Flag: 第十六条

　 下列人士逝世，举行哀悼仪式时，其遗体、灵柩或者骨灰盒可以覆盖国旗：

　(1) The persons provided for in paragraph 1(1) to (3) of Article 15 of this Law; （一）本法第十五条第一款第一项至第三项规定的人士； (2) Martyrs; （二）烈士； (3) Other persons provided for by the state. （三）国家规定的其他人士。

　The National Flag covering the remains, coffins or urns may not touch the ground, and shall be taken back for safekeeping after the ceremonies. 覆盖国旗时，国旗不得触及地面，仪式结束后应当将国旗收回保存。

　Article 17 When the National Flag is displayed, it shall be placed in a prominent position. 第十七条

　升挂国旗，应当将国旗置于显著的位置。

　The National Flag, when raised or carried in a procession with another flag or flags, shall be in front of the other flag or flags. 列队举持国旗和其他旗帜行进时，国旗应当在其他旗帜之前。

　The National Flag, when displayed with another flag or flags, shall be either at the center, above the other flag or flags, or in a position of prominence. 国旗与其他旗帜同时升挂时，应当将国旗置于中心、较高或者突出的位置。

　When the National Flags of two or more nations are displayed in foreign affairs activities, relevant provisions of the Ministry of Foreign Affairs or the international practice shall be followed. 在外事活动中同时升挂两个以上国家的国旗时，应当按照外交部的规定或者国际惯例升挂。

　Article 18 The National Flag, when hoisted or lowered from a vertical staff, shall be hoisted or lowered slowly. When hoisted, the National Flag must reach the peak of the staff; when lowered, it may not touch the ground. 第十八条

　 在直立的旗杆上升降国旗，应当徐徐升降。升起时，必须将国旗升至杆顶；降下时，不得使国旗落地。

　The National Flag, when flown at half staff, shall be first hoisted to the peak of the staff and then lowered to a point where the distance between the top of the Flag and the peak 下半旗时，应当先将国旗升至杆顶，然后降至旗顶与杆顶之间的距离为旗杆全长的

　of the staff is one third of the length of the staff; the Flag, when lowered, shall be again hoisted to the peak before it is lowered. 三分之一处；降下时，应当先将国旗升至杆顶，然后再降下。

　Article 19 No damaged, defiled, faded or substandard National Flag shall be raised or used, and the National Flag shall not be displayed upside down, inserted upside down, or displayed or used in any other manner that undermines the dignity of the National Flag. 第十九条

　 不得升挂或者使用破损、污损、褪色或者不合规格的国旗，不得倒挂、倒插或者以其他有损国旗尊严的方式升挂、使用国旗。

　The National Flag shall not be discarded at will. The damaged, defiled, faded or substandard National Flag shall be taken back and disposed of in accordance with relevant provisions issued by the state. After a large-scale mass activity comes to an end, the organizer of the activity shall take back or properly dispose of the National Flag used on site. 不得随意丢弃国旗。破损、污损、褪色或者不合规格的国旗应当按照国家有关规定收回、处置。大型群众性活动结束后，活动主办方应当收回或者妥善处置活动现场使用的国旗。

　Article 20 The National Flag or the design thereof shall not be used as a trademark, for the design for which a patent right is granted, or for commercial advertising purposes, and shall not be used in private funeral activities or under other inappropriate circumstances. 第二十条

　 国旗及其图案不得用作商标、授予专利权的外观设计和商业广告，不得用于私人丧事活动等不适宜的情形。

　Article 21 The National Flag shall be taken as an important content of patriotism education. 第二十一条

　 国旗应当作为爱国主义教育的重要内容。

　Primary and secondary schools shall educate students on the history and spiritual connotation of the National Flag, and observe the rules on the raising and use of the National Flag and the etiquette in a Flag-hoisting ceremony. 中小学应当教育学生了解国旗的历史和精神内涵、遵守国旗升挂使用规范和升旗仪式礼仪。

　News media shall vigorously publicize the knowledge on the National Flag and guide citizens and organizations in the correct use of the National Flag or the design thereof. 新闻媒体应当积极宣传国旗知识，引导公民和组织正确使用国旗及其图案。

　Article 22 The General Office of the State Council shall make overall plans for and coordinate the work concerning the administration of the National Flag nationwide. The local people"s governments at all levels shall make overall plans for and coordinate the work concerning the administration of the National Flag within their respective administrative regions. 第二十二条

　 国务院办公厅统筹协调全国范围内国旗管理有关工作。地方各级人民政府统筹协调本行政区域内国旗管理有关工作。

　The market regulatory departments of the people"s governments at all levels shall conduct supervision and administration of the making and sale of the National Flag. 各级人民政府市场监督管理部门对国旗的制作和销售实施监督管理。

　The departments determined by the people"s governments at the county level shall conduct supervision and administration of the raising, use and withdrawal of the National Flag within 县级人民政府确定的部门对本行政区域内国旗的升挂、使用和收回实施监督管理。

　their respective administrative regions. The Ministry of Foreign Affairs, the transport department of the State Council and the relevant departments of the Central Military Commission shall conduct supervision and administration of the raising, use and withdrawal of the National Flag within their respective jurisdictions. 外交部、国务院交通主管部门、中央军事委员会有关部门对各自管辖范围内国旗的升挂、使用和收回实施监督管理。

　Article 23 Whoever desecrates the National Flag of the People"s Republic of China by publicly and willfully burning, mutilating, scrawling on, defiling or trampling upon it shall be investigated for criminal responsibilities according to law; where the offence is relatively minor, he shall be detained for not more than 15 days by the public security organ. 第二十三条

　 在公共场合故意以焚烧、毁损、涂划、玷污、践踏等方式侮辱中华人民共和国国旗的，依法追究刑事责任；情节较轻的，由公安机关处以十五日以下拘留。

　Article 24 This Law shall enter into force as of October 1, 1990. 第二十四条

　 本法自 1990年 10 月 1 日起施行。

　APPENDIX: 附：

　DIRECTIONS FOR THE MAKING OF THE NATIONAL FLAG 国旗制法说明 (Promulgated by the Presidium of the First Plenary Session of the Chinese People"s Political Consultative Conference on September 28, 1949) （1949 年 9 月 28 日中国人民政治协商会议第一届全体会议主席团公布）

　The shape and colour of either side of the National Flag shall be identical, whereas the five stars on both sides of the Flag shall be opposite to each other. For convenience"s sake, these directions shall take the circumstances where the staff is on the left as the basis for illustration. Where the staff is on the right, the word "left" used in these directions shall all be changed to "right", while the word "right" referring to direction shall all be changed to "left". 国旗的形状、颜色两面相同，旗上五星两面相对。为便利计，本件仅以旗杆在左之一面为说明之标准。对于旗杆在右之一面，凡本件所称左均应改右，所称右均应改左。

　(1) The face of the Flag shall be red and rectangular; the proportion of its length and height shall be 3 to 2. The upper left of the face of the Flag shall be studded with five yellow five-pointed stars. One of the stars shall be bigger than the others, with its circumcircle"s diameter being three-tenth of the height of the Flag, and shall be placed in the left; the four other stars shall be smaller, with their circumcircle"s diameter being one-tenth of the height of the Flag, encircling the big star on its right in the shape of an arch. The cover of the staff shall be white. （一）旗面为红色，长方形，其长与高为三与二之比，旗面左上方缀黄色五角星五颗。一星较大，其外接圆直径为旗高十分之三，居左；四星较小，其外接圆直径为旗高十分之一，环拱于大星之右。旗杆套为白色。

　(2) The five stars shall be positioned and drawn as follows: （二）五星之位置与画法如下：

　a. To determine the position of the five stars, the face of the Flag shall be first folded both ways to form four equal rectangles; then the rectangle on the upper left shall be vertically divided into ten equal sections and horizontally divided into fifteen equal sections. 甲、为便于确定五星之位置，先将旗面对分为四个相等的长方形，将左上方之长方形上下划为十等分，左右划为十五等分。

　b. The central point of the big five-pointed star shall be at a point in the rectangle where the fifth line from above (or the fifth line from below), and the fifth line from the left (or the tenth line from the right) meet. The method of drawing shall be: taking this point as the centre and the length of three such equals as the radius to make a circle. On the circumference of this circle, five points with equal distances from each other shall be determined, one of the points must be in the right above position of the circle. Then connect each of the five points with every other point to form a straight line respectively. The outline formed by these five straight lines shall be the required big five-pointed star. An angle of the five-pointed star shall point in the right above direction. 乙、大五角星的中心点，在该长方形上五下五、左五右十之处。其画法为：以此点为圆心，以三等分为半径作一圆。在此圆周上，定出五个等距离的点，其一点须位于圆之正上方。然后将此五点中各相隔的两点相联，使各成一直线。此五直线所构成之外轮廓线，即为所需之大五角星。五角星之一个角尖正向上方。

　c. The centres of the four small five-pointed stars shall be as follows: the first shall be at a point, in the rectangle, where the second line from above (or the eighth line from below), and the tenth line from the left (or the fifth line from the right) meet; the second shall be at a point where the fourth line from above (or the sixth line from below), and the twelfth line from the left (or the third line from the right) meet; the third shall be at a point where the seventh line from above (or the third line from below), and the twelfth line from the left (or the third line from the right) meet; the fourth shall be at a point where the ninth line from above (or the first line from below), and the tenth line from the left (or the fifth line from the right) meet. The method for drawing shall be: taking each of the above four points as the centre and the length of one such equal as the radius to make four circles. On each circle, five points with equal distances from each other shall be determined. One of such points must be on the line linking the centre of the circle with the centre of the big five-pointed star. Then the same methods used in forming the big five-pointed star shall be used to form the small five-pointed stars. The four small five- pointed stars shall respectively have an angle pointing right at the centre of the big five-pointed star. 丙、四颗小五角星的中心点，第一点在该长方形上二下八、左十右五之处，第二点在上四下六、左十二右三之处，第三点在上七下三、左十二右三之处，第四点在上九下一、左十右五之处。其画法为：以以上四点为圆心，各以一等分为半径，分别作四个圆。在每个圆上各定出五个等距离的点，其中均须各有一点位于大五角星中心点与以上四个圆心的各联结线上。然后用构成大五角星的同样方法，构成小五角星。此四颗小五角星均各有一个角尖正对大五角星的中心点。

　(3) The measurement in common use for the National Flag, from which people from various circles may choose at their discretion shall be as follows: （三）国旗之通用尺度定为如下五种，各界酌情选用：

　a. 288 cm. in length, 192 cm. in height; 甲、长 288 公分，高 192 公分。

　b. 240 cm. in length, 160 cm. in height; 乙、长 240 公分，高 160 公分。

　c. 192 cm. in length, 128 cm. in height; 丙、长 192 公分，高 128 公分。

　d. 144 cm. in length, 96 cm. in height; 丁、长 144 公分，高 96 公分。

　e. 96 cm. in length, 64 cm. in height. 戊、长 96 公分，高 64 公分。
