众所周知,中国文化源远流长、博大精深。法律文化也是中华文化的重要组成部分,且经过各个朝代的不断演化与当代中国的发展,呈现出一种繁荣的局面。

首先:中国古代法律是诸法合体,以刑为主,在各种法律规范中,刑法是一支独秀,受到历代统治者的倍加关注。其中让我印象比较深刻的是车裂、剥 皮、烹 煮等非常残酷的刑罚。中国古代刑法文化源远流长,为中国的奴隶社会、封建社会和半封建半殖民地社会形态的演变和发展作出了巨大的贡献。中国古代法律也是是“礼治”与“法治”相结合的法律传统。

当代中国的法律体系通常包括下列部门:宪法、行政法、民法、商法、经济法、劳动法与社会保障法、自然资源与环境保护法、刑法、诉讼法。这些法律共同组成了中国特色社会主义法律体系。

1. 宪法作为一个法律部门,在当代中国的法律体系中具有特殊的地位,是整个法律体系的基础。
